these services.
Changing or Extending your Status while in the US
Applicants might apply for a US visa to work under a certain category, but then their intent, motivations, or circumstances change resulting in a desire to change or extend their status while in the US.
Each circumstance is unique in each particular situation, so please contact our branch office to see what types of US visas, if any, are available to you.
Waivers: Criminal Convictions, Overstays, or Deportation/Removal
Persons who have certain criminal convictions; who have overstayed previous stays in the US; or were deported from the US may be prevented re-entry into the US unless they seek a waiver from US embassy with jurisdiction over their home country.
These issues are highly complex and we highly recommend that you contact our US branch office to see if you qualify for any waivers that would enable you to return to the US.
Please note that to qualify for a waiver; you must have an existing relationship with a US citizen in an immediate relative capacity or demonstrate a certain level of hardship to warrant a grant of such waiver.
Deportation Defence
If you are a foreign national who has been picked up by the US Immigration and Customs Enforcement and placed in removal proceedings from the Department of Homeland Security in the US, contact our US branch office immediately to see if you qualify for any forms of relief that would prevent your removal from the US.
It is highly recommended that you seek legal counsel from a jurisdiction of which you have been placed, but our US branch office may be able to offer you assistance upon completion of an inquiry.
Human Resources (I-9 Compliance)
With so many visa categories and new changes in US regulations, it is difficult for many human resource departments of US-based companies to keep up with the various statuses and classes of foreign employees.
Further, the US government has cracked down on illegal immigration in the past few years and have increased fees, penalties, and sanctions for employers who employ illegal workers. As such, it is extremely important that human resources personnel keep their employee files organized and pre-empt any audits or raids by the US government.
Our branch office in the US can help ensure that your human resource department is complying with US immigration laws without discriminating against foreign employees. We can assist your company in being proactive against any investigations so that your company does not suffer any significant disruptions in operations.
