Different types of ENS visa for Australia
In Australia, employer nomination is a way for businesses to recruit highly skilled overseas workers to immigrate with an Australia Visa to fill permanent roles. As a skilled foreign worker, there are two options for getting an ENS visa:
- If you are already living and working in Australia on a qualifying visa, you can apply for an ENS subclass 856 visa. If your qualifying visa expired no more than 28 days before making your ENS application, you may still be eligible.
- Overseas workers who are currently outside Australia can apply for the 121 visa. The ENS (subclass 121) visa is also available to applicants who are in Australia without a qualifying visa. They may lodge an application while in Australia, but must be outside the country when that visa is granted.
How the employer sponsored visa works
For the issuing of a permanent employer sponsored visa, Australia sets out these criteria:
- An Australian employer nominates the role to be filled and finds a suitable overseas candidate who is willing to do that job in Australia.
- The nominated employee accepts the job offer and applies for a visa – either subclass 856 or 121.
To qualify as an eligible occupation, the job must be full-time for a period of at least three years and covered by the Employer Nomination Scheme Occupation List (ENSOL). The nomination must be approved before an Australia visa can be granted, and it remains valid for up to six months while a visa is being processed. Some people also benifit from study in Austalia as this can also lead to a work permit or the skilled regional sponsorship.
