    hi,

    I applied for a PSW visa in the UK in Jan, my student visa expired on the 31st of jan.my psw application was denied and passport returned on 1st mar 2009. i had the right to appeal until or by the 17th of march. I decided not to appeal because the refusal was due to maintenance funds and I realised I was wrong. I left the UK on the 27th of march, as i had to resign from my job and sort out house contracts.

    I am now back in my country and thinking of reapplying, I have maintained the acct balance and have all other documents, my only fear is the period I overstayed. Will it be an issue?

    It all depends why you were refused a visa. It is not against the rules to be refused a visa. Often it is down to a miss understanding only. I think you should go for it and cross your fingers. Or use Global Visas for the more relaxed approach.

    Hi Gareth,

    I wonder if you can help. I’m a British citizen who has just returned to the UK from Malaysia a couple of weeks ago. While in Malaysia i got married to my Malaysian wife in a ceremony over there.

    We are now looking to process an application for her Visa.

    We are going for a UK Settlement Visa
    She’s a part-2 qualified architect, just in case that has any relevance.

    However, i have returned and need to find employment, hasn’t been a problem before (got degrees etc), so the financial side of the form might not pass as you need 3 months of salary, is that correct?

    Or could my brother (her brother-in-law) be her sponsor?

    We both live in the same big flat and he’s been in employment the last 4 years so has all the necessary documents.

    Is it best to apply with my brother as sponsor or have patience and wait the 6 months or so until i could make a successful application?

    Is it common to reject sponsorships by family members for UK Settlement Visas?

    Dear sir
    I’m non EU nationality and had 3 dependents. I am going to apply ILR next month on 5 year WP basis.
    But great concern is that 2007 Jan to May we received child and working tax credit for 5 months, after we discovered we are not entitle to any credit due to ” No Public resources”.
    We stopped these credits and sent letter to HMRC for how to refund it. Then they only sent us overpayment letter so we paid it.
    But what we paid back is less than what we received.
    Now we are filling SET(o) form and “are you receiving any public funds?’
    Don’t know what shall i answer..

    Could you please kindly give me an advice ?

    My advice is relax. Everything will be fine. I would fight your case any day of the week. The law is never meant to be broken BUT mistakes can happen.

    I came to England ’02 aged 17 on a two year visa to stay with my sister-who’s british by birth and my senior by 11+ years (she’s also my only sibling)About a month before my visa ran out I ran away(could not entertain the thought of leaving the country for any reason) and only just came back to hers recently-last week.In the time I’ve been away I’ve had a son, he’s 3yrs old now though I’m not with his mum-whose also british. Now I’m proper stressed out and desperate to get out of this ‘limbo’.What are the possibilities and options available to me??

    jus to add to the previous message one of the main reasons i didn’t want to return even for a day to reapply or extend it out there was because about 2 or 3 months before I came to stay,we had an encounter with armed men who broke into the house and had guns drawn at my head in my mums presence(im her only son)She suffered a stroke soon after and I was then sent to England to stay with my sister.I was traumatized for many years after and this is the reason I would not set foot in that country.What can I do to become british?pls advice-got plans but i’m been held back for instance I would love the opportnity to further my education

    You must regulate your stay. You have not said if your partner is working and many other facts have not been included. Over all I would suggest you mary your partner or at worst aim for a Common law spouse visa. This will involve going home briefly but I am certain we can bring you back quickly.

    Hi there,

    I have a EU family member 5 yr visa which allows me to work and stay here, as Im married to a Portuguese citizen. We been married since feb 07 and I have my visa since Aug07. Unfortunately my husband cheated on me and now has a child with another women and I want to see will have the right to stay in the country if I apply for a divorce? Im currently working full time and taking a part-time degree in a UK University.

    I spent 12 months out of 14 months in the Uk on a 2 year holiday visa taking a series of short courses. I had no idea one required a sort of study permit for even short courses, some of them lasting only a week.
    I did know however that my maximum time allowed at any time was 6 months and so i made sure i never exceeded 3 months at any given time by travelling out of the UK in between the courses.
    However on one of my return trips i was refused entry by the Uk border agency and subsequently had my visa cancelled and then issued a one year reentry ban before being repatriated to my country voluntarily at my own expense.

    I would just like to know, what my chances are after the ban runs out of ever getting a british visa in the future. I sincerely and truly have no intentions of ever migrating to the UK, otherwise i would not have bothered at great expense trying to stay within the law by travelling back and forth so many times.

    Please give me your honest opinion and advise, any reply would be highly appreciated.

    You may have a right to stay but not based on the relationship. How else could we look to keeping you in the UK?

    My friend is in dilemma at the moment.He came to the country under fiancee visa and was given 6 months to stay. His relationship didn’t work out but he continued to stay in the UK as he thought of leaving after his visa runs out.Eventually he decided to stay but it was too late to sort out his papers as he overstayed already (that’s his thinking). He met his current partner about 5 years ago and she’s applied for EEA2 for him last 2007. His application is now being under consideration provided he submits all documents required. He was able to produce everything except for the NHS card. He did try to apply for this when he still has a valid visa but was rejected as there was only 6 months stay stated on his passport. He was given papers by the Home Office just to say that he can work until they issue their decision in 6 months. It’s been over a year now that he is working and now that his papers are back on track, he wants to know whether he can now apply for the NHS using letter from HO stating he’s applied for the EEA2. Do you know why HO need the NHS card? Is it to know if he is accessing public funds? He has tried to apply for a comprehensive health insurance but they won’t accept him either without GP registration. He was given two weeks deadline to produce an NHS card. Thanks in advance. Your help is very much appreciated.

    I need your advise on how to get a visitors visa for my daughters fiance ( he is Egyptian). Currently my daughter is in Egypt. She and her fiance have started a small business in a hotel. My daughter plans to come back to England in the new year to visit family and attend a wedding of a close family friend. How do we go about applying for visa for her fiance?     I am in aggrieved dont know what to do.I have beenstudying in uk since 2001 and having renewed my visa soundly having done my undergraduate degree and masters degree recently. I decided to apply for tier 1 post study work visa and was declined due to maintainance issue.Dint even know i was meant to maintain £1333 for myself and daughter anyway my application was declined and right of appeal given. Appealed through some solicitors provided statements and cover letters from an account held in a credit union and an account held abroad. Have received the determination which states i submited fake and ungenuine documents and dismissed my appeal Applied for reconsideration which was rejected as no error of law. Now the letter received after application for reconsidration from senior immigration judge contain an error implicating i was meant to show £800 which i did not, he dint even look at the documents supplied in the appeal hearing. Now have made an pplication to high court for reconsideration. Do you think i will succeed bearing in mind that all the information submitted is all genuine and have never even submited fake document ever. Dont even know where to get them from. Please any advice is apprecited and thank you applied

    i’m applying for a fiance visa to the UK. How long after it is issued do I have to travel to the UK? I can’t seem to find that answer online or on the UK Border site. Also do I have to stay in the UK? I was also wondering if I can travel back to the US and come back before or after getting married. Can I enter the UK on the fiance visa a few times during the 6 months it is good for is my second question?

    I applied for a uk student visa last july 2009, however I was refused. I re-applied last Sept. 30, 2009 until now my visa is still under process at the British High Commission, I thought Student Visa for uk takes only 30 days maximum processing time, I was not able to catch up as the semester started. Fortunately, I was able to apply for a job(3 year contractual), for now I’m still waiting for the final interview with my employer, hopefully I’ll be hired. My prospect employer doesn’t know yet that I have a pending UK Student Visa application. If ever my student visa will be approve, can I switch to a Work Sponsorship Visa even if I’m still in my home country? How long would it take so I can travel As soon as possible? Thank you so much!

    Your student visa should come through very quickly. What happens if you get the job? You can not be a student and work permit holder. You should wait before you travel to see if you receive a work permit.

    Hi. I’m not sure if this is where I contact yourselves. I was wondering if you can help.I’m American and from Oklahoma. I applied for a UK fiance visa in June 09, and recieved a reply to say the application had been opened on June 18th 2009.However I haven’t heard anything else since.I tried World Bridge services,and I just got a standard email.     It sounds like at best your case has fallen into a hole. You need to reach out to the people in power now. The guys on the front desk will just continue to brush you off. Bang your drum and make a fuss. The other option is ask us to do it for you.

    The idea of using your child to secure ILR in the UK has been stopped. You may have other routes to UK Citizenship over time but a baby does not fast track that process.

    Dear Gareth,
    I applied for tier 4 general student – dependent visa from India, Bombay for UK as my wife is already pursuing her course in UK outer London and i intend to join her to stay together as we recently got married a year and 4 months ago.
    I was refused 3 times :
    1. due to not showing accommodation evidence, marriage certificate not being genuine and hence question on relationship being genuine.
    2. due to maintenance funds, though my bank certificate and passbook balance did reflect more then the required amount. the only problem was it was a savings plus account where amount moves from current to fixed deposit automatically hence the passbook given did not show the current amount enough to cover the funds though the modular amount did show the funds required still i was denied on that grounds.
    3. due to not showing maintenance funds for my wife but they were convinced with my maintenance funds given.
    As per the immigration rule 319(C)(g) if i am applying separately which i have to logically (as my wife is already being issue a valid UK visa on which she is pursing her masters in UK outer London) i only need to show maintenance funds for my application which is for a period of 28 days prior to application date and that has been satisfied.
    — i need your help with regards to appealing this 3rd decision of refusal to ruled it in my favor and get my visa issued. also please confirm if i am on the positive side as per the decision given.

    Well it is good to see you have read the Immigration rules. A little knowledge can be a dangerous thing!.. I you now apply (for the next 10 years) they will link your new case with your old one. You are not independent of your wife and as an ex immigration officer I would have looked to refuse.

    You MUST confront the issues of your previous case – Did you sumbit a fake marriage certificate?

My fiancee is on a UK fiancee visa and arrived in the UK a couple of days ago,we are not married yet,but I was wondering is she entitled to free NHS treatment from the GP(free prescriptions).Also if she had to go to hospital,emergency,or otherwise, is she entitled to free treatment? I couldn’t find the answer to this anywhere.

    I was given a 3 year student visa to complete an MBA which had 2 stages: a postgraduate Diploma and then the top-up masters. When I completed the postgraduate diploma, the college I was with got into problems with the University awarding the Masters, and we were therefore in limbo for alomost 7 months while the issue was being sorted. During that time, I moved to another college to complete my studies due to the uncertainty. I am now about to finish my MBA and would like to apply for Post study Work. What I am not sure about is whether the gap in my studies will invalidate my application?

    Yes it is. There are several things that need to be addressed. The excuse “My Father hid my Passport.” is not one you could use. As an adult it is your choice if you allow your father to interfere like this. You could have called the Police and had him arrested as he has no rights to do this.

    A good question. you may have seen Global Visas write about the MAC recommended changes to the Tier 1 system….. again!

    They are now suggesting reducing the Masters degree requirement to a bachelors. This would of course change the whole look of the system. I do not know how much time you have left but if you can hold on then it will be better for you.

    A good question – I would argue yes, she is entitled to free NHS care. Each local health Authority has a differnt view on this but the are all in agreement. They will NEVER deny anyone who is in need of emergency treatment. I wish you all the happyness in your up comming wedding.

    hi i need some help. i got married to a guy in pakistan, it was all because of my family pressuring me. when we got back to the uk, my family applied for him straight away knowing that i did not want him here, his visa was refused first time round, and then my parents appeald. i am currently waiting for the outcome. i want to know
    can i specifically ask for his appeal be refused if i get into contact with the britisb high commission, if my reason is we are incompatible. i do not want my parens to find out that i am doing this. so if they refuse his appeal on the basis of incompatability will they write that in the letter to him or myself or can i ask for another reason to be put foward to them or will everything be kept confidential and the reasons i list tthe commission will not be listed foward to them

    YES, YES, YES you can speak to the entry clearance office dirrectly or the UK BIA with your case details. They will NEVER disclose the reason for the refusal and it will remain 100% confidential. You must be honest with the authorities now before it is too late for them to help you.

    I have been with my partner from NZ for two years and he has an ancestory visa, I’m a british citizen. However, the visa states ‘to accompany partner’, as he came to the UK with his NZ girlfriend, who’s grandparents were from the UK. She was here for 6 months, then left to go back to NZ. My partner decided to stay and already had a job, flat etc and didn’t think anything of it. We visited a European country for work and when he came through passport control (back to UK) he was asked where his partner was (as we then found out he’s supposed to accompnay her). He said she was at home, suddenly cottoned on to what was happening and said it was a work trip and she’s here in the UK. Now we think his visa isn’t valid, as he can only be in the UK with his ex? We have been together for two years and living together for 20 months. Can anyone help as we don’t want to be seperated or for him to be sent home! Can he swap his visa here in the UK to a different one or will he be sent home and have to reapply from NZ?

    Hi, i was arrested for questioning last year, the charges were dropped (it was a dispute between me and my manager for a student job-i’m here on a student visa-that’s obviously not my career path and she did it to the rest of the staff as well, who left the store btw). I intend to marry my partner but i’m scared that the arrest may be a reason for rejecting my civil partnership/marriage visa. Will it create a problem for me? even though i was never trialed and i was called the same night to know that the charges were dropped (they even asked me to come back, they said it was just company procedure… :S).

    Hi, I am seeking help for my sister who finished her medicine 8 months ago in India and willing to move to UK. we have many doubts and confusions due to the various restrictions placed on doctors. It looks like she can apply for PSW or post study work permit (as her qualification is recognised and she gained enough points to apply for it). If she gets this Visa can she write PLAB2 and take up employment here?

    my wife was deny a psw dependent visa on January 2010 due to the fact that her previous student application on march 2009 she included a false bank statement from her sponsor. She never knew the validity of the statement as she was in Malaysia at the time of receiving the statement from africa.Due to this she was ban for 10yrs, we have appeal last month. I will like you to advise accordingly on the success of the appeal ad how to go about it

    Hello Gareth. I am an US citizen living and working in Mexico with my FM3 work visa. I am in love with a Mexican man here and have been with him for 7 years this April. He has been working on getting his tourist visa to the US. We both do not feel comfortable getting married before he even steps foot in the country we intend to live in. Does it hurt our chances in the future of getting a fiance visa or green card for him if he gets his tourist visa first and uses it as a tourist visa for a year or so first?     Hi, I hold the Visa Tier 1 ( General ) Migrant for 3 yrs. 06/01/09 – 06/01/12. My first entry in UK was on 09/04/09 and stayed upto 17/04/09 Then I permanantely migrated to UK on 08/08/09.Afetr which I had gone on an official visit to Spain for 3 days and am planning to go for an official visit to India for 13 days will this in any way obstruct in applying for an extension or for the ILR, once I have completely stayed in UK for 5 years.     Hi,

    I have a choice between the Tier 1 (post-study visa) and the Tier 5 (youth mobility visa – as I am from Aus). I would prefer to apply for the Tier 5 one as its cheaper.

    My question is: if I get the Tier 5 youth mobility visa, am I able at the end of the 2 year period when it expires, to apply for a highly skilled Tier 1 visa? Or does holding the Tier 5 preclude one from applying for a Tier 1?

    you are right you can apply for another visa – as long as you qualify, so that it runs concurrently to your previous visa.

    However, I would advise that you go straight ahead and apply for the tier 1, why burden yourself with the hassle of re-applying or worse that visa rules might change, so that you are not eligible anymore.

    My have left the UK but am planning to return.

    The Tier 1 post study visa clearly states that one can switch to Tier 1 (General) when it expires, if one qualifies under the points based system.

    However, I cant seem to find anything to a similar effect for Tier 5. Where is there info that one can switch to a Tier one after the Tier 5 expires (assuming that you have enough points)?

    I see what you are saying about the post study visa but its double the price for the same period as the Tier 5 and the Tier 5 has a shorter waiting period.

    My husband is still trying (third time!) to apply for the WP Tier 2 PBS dependant category. I have been working here in UK as a teacher for nearly 5 years now and got married 2 years ago. First time it was refused under 319(c, 320,320(8a). We were wrongly advised by the Home Office UK and has since then acquired all the documents needed. We were advised to appeal from the letter of refusal. We did just that and were told a month later that they cannot make a decision and that our appeal will be sent to AIT UK. We then withdrew because it will take too long to process and has decided to apply again next week with extra documents (all of the documents that I sent out when I first apply for my work permit). Will my husband has the chance to get his Leave to remain?? Please advise, we’d appreciate…thank you kindly..

    I’ve been in UK for past ten years and now considering to apply for ILR (10 year category). There are no gaps in visa validation.

    I did spend 8 months out of UK due to an accident which required immediate surgery and then recovery. My total absence from UK in last 10 years is +/- 400 days.

    I gave birth to newborn daughter on Mac 2009. We are going a holiday on end April until the immigration officer found out my daughters doesnot has visa and she is given 2 months temporary visa.

    I’ve a question on a very touchy subject. I am a female US citizen and have lived in the US my entire life, having only been outside of the country once on a short visit to Ireland. My friend, being a male resident of Ireland, will be coming to visit in a few short weeks.     If it is urgent then you can simply come here as a visitor, if you wish to work you will have to apply under the stated routes, with your background you should qualify for a work visa. Work visa applications will take at least 6-months.

    I need some advice regarding entering the UK. i have read all the options but need some expert advice on which is the better option.

    I lived in the UK for 7 years on my ancestry visa. I got my indefinite leave to remain, did my life in the UK test but then never applied for the British passport, I then left the UK in December 2007 to return to South Africa and have been out of the UK for 2 and a half years. Since then I have married a British Citizen and we would like to return to the UK next year.

    Apparantly I can also obtain my British passport as I fall under the new law ‘applying for a British passport if I was born before 1983 outside of the UK and from a British mother.

    I have been reading all the information on the net and don’t know which way is best to go forward.

    Please can someone suggest the best option for me. You’re response would be hugely appreciated.
