There has been a decline in the approval rate for US L-1 visas for Indian professionals. New data shows that the US L-1 visa denial rate is higher in India than in any other country.
The National Foundation for American Policy has released data showing the number of L-1 visas issued to Indian nationals fell by 28 percent in the period 2010 to 2011. The data shows that L-1 visa approvals went from 35,896 in 2010 to 25,898 in 2011, a drop of approximately 10,000 visas. At the same time L-1 visas issued to employees from other countries rose by 15 percent.
“This shows an enormous gap in visas issued as well as approval/denial rates between posts in India and the rest of the world, raising policy questions as to whether this great disparity is the result of a conscious policy at US posts in India,” the National Foundation for American Policy wrote in its report.

Hillary Clinton has ordered a review of the J-1 Summer Work Travel Visa, which, it has been claimed, has been abused by criminals and business looking for cheap labour.
The Secretary of State said she wants an “extensive and thorough review” of the programme in order to prevent it being used for people trafficking. The move follows the revelation that a federal indictment accused mafia members of smuggling women from Eastern Europe to work in the sex industry, by using the visa class.
The J-1 visa was launched in 1963 with the intention of allowing college students to visit the US over their summer breaks to travel and work. The programme now allows more than 100,000 young people into the country each year. However, far from being a positive experience, many young US visa holders find they end up working in poor conditions with minimal pay, according to a report by the Associated Press.

US Citizenship and Immigration Services (USCIS) has announced they are in the post-development testing phase of a new online application system that will eventually change the paper-based agency into an electronic, online organisation.
The new Electronic Immigration System (ELIS) will reduce the US immigration department’s reliance on paper and make it easier to access information for benefit requests. The tool is designed to digitize the current paper documentation review by allowing US visa applicants to submit and track their applications online.
“This is an unprecedented step for the world’s largest and most complex immigration system,” said the USCIS . “Past efforts to transform our agency have not reached the point where we are today: the testing phase of a system that has been developed.”

US Citizenship and Immigration Services (USCIS) announced they have received enough petitions for graduate level skilled workers under the H-1B visa program to meet the cap of 65,000 for fiscal year 2012. This is the earliest the visa cap has been reached in the past three years, signifying renewed demand for this visa program.
Each year on April 1 the USCIS begins accepting H-1B petitions for the new fiscal year; USCIS announced the cap for H-1B visa applications was officially reached on 22 November, two months ahead of last year.

One bit of good news for graduate level skilled professionals wishing to work in the US is that there are still plenty of US H-1B visas available. This is an indication that the US economy is still not doing very well. Before 2008 in some years H-1Bs were used up almost as soon as they became available.
If you are an employer you can employ new professional level staff quite quickly. If you pay the premium processing fee it may be possible to bring in a new graduate level staff member within a few weeks. The earliest start date for an H-1B is 1 October 2011. Therefore employers and skilled workers no longer have to wait for the H-1B start date before starting work.

As there continues to be dis-content across the USA – with the new Arizona immigration law (even though it is yet to come into effect), and the latest news that the city of Sacremento in California has joined four other cities in boycotting the state over the issue of US immigration, I stumbled across some moving images of immigration rallies across the USA.
I think the best words to describe these would be that we are all human and this is the message we should all remember.












The issue of immigration in the US is still a red hot coal of contention and there is still no sign of the US immigration reform that was promised by Barack Obama – as was promised before he was elected. These people for one hope that it comes to fruition.
