HSMP/ Indefinite Leave to Remain (ILR) Judicial Review
The Home Office has published important changes to Indefinite Leave to Remain (ILR) following their defeat by the HSMP Forum in the High Court.
Did you receive an HSMP approval letter before 3 April 2006 and were granted Entry Clearance or Leave to Remain (LTR)? Do you fall into one of the following categories?
1. Have you already settled in the United Kingdom under HSMP or Tier 1 (General) on the basis of having completed five years continuous residence in a qualifying category?
2. Have you completed four years continuous residence in the United Kingdom in a qualifying category?
3. Are coming up to having completed four years continuous residence in the United Kingdom in a qualifying category
4. Did you apply for ILR after four years but were refused, and either:
- won an appeal against the refusal decision and were then granted permission to stay,
- did not appeal the refusal decision or have your appeal dismissed
5. Did you complete four years continuous residence in the United Kingdom in a qualifying category and submit an application for Further Leave to Remain (FLR)
If you fall into any of the above categories you are most likely eligible for a one-off payment from the Home Office and can apply for settlement immediately.

I would like to know, if Iam lready in title to ask an acquire about my immigation case to the Home Office. So I live in UK for more than 5 years and I have been in an Education so far, right now Iam at University without my ILR AND IS realy difficult to cope with all expenses even with help with my Student Finance (LOAN, I need to get my ILR because it has been difficult to get a job without my state. would like to know, how shall I approach the Home Office on this matter. Please I want to get your advice.

I have stayed in uk for 4yrs under HSMP and have FLR for another 3yrs on my passport. How do i apply for one -off payment? can i submit my ILR form with the one-off payment application? Does it mean i wont have to make any payment with my ILR form?

Hi,
I applied for HSMP on Jan 2006 and I got the confirmation letter in jan. However, since I had a SEGS visa, I applied for the HSMP visa after the April, 6th. Am I eligible for the new rule to apply for ILR at the end of 2009?

RE: HSMP/ Indefinite Leave to Remain (ILR) Judicial Review
I received my HSMP approval letter before 03/04/06, ie before the change from 4 to 5 years continious residency. However I did not arrive and get entry clearance in the UK until 16/06/06. Can you please advise if I can apply for ILR after 4yrs instead of 5 yrs.
Also, do I need to provide original approval letter from the Home Office as part of my ILR application?

Hi ,
I have completed 5 years of my stay in Jun 2009 on combination of WP/HSMP and I have a medical absence from UK starting feb 2006 till Oct 2006.(approx 8 month)In this duration I was still with the same company but was working from india and getting indian salary.My WP was also valid .In oct 2006 I switched to a new company and came back to UK .Can some one please suggest if I should try for ILR or not.
I got my HSMP from Jan 2008
First arrival date in UK Jul 04
As a medical proof I have GP letter ,indian r report and letter and some hospitalisation doc too.

My HSMP approval letter was issued in December 2005, then i applied for Visa in April 2006, and got my Visa initial Visa in May 2006, but i dont have any evedence of my application submission date nore my initial HSMP approval letter. how and when i can apply for ILR. ?
Could you please guide me in this matter.

I was given work visa on 25 January 2005for nursing when should I apply for indefinate live to remain in uk?
Is it 4years or after 5 years?I do not understand the indefinate leave to remain under judicial review policy document.

Hi,
MY HSMP expired in Mar 2009 but I applied for a FLR in Oct 2008 under the Judicial Review and I paid 750 for the renewal.
I was told that the current renewal for Judical review is only 350. Is this correct? If yes, am i able to get back a refund from Home Office?

I got the visa stamp on September 2006. I have no idea when i get the Approval letter. But as per my knowledge I get the approval letter month August 2006.
I want to know when I can apply for ILR application and how much balance require to show at the time of ILR. When i can apply for ILR please request to help me.

I have a query i hope you would help with. I applied for the HSMP before April 2006 but my approval letter was dated Aug 2006. Do i need to provide any sort of evidence to show the date that i applied? If yes, can you please list the evidence i need to provide?

As an hsmp migrant favoured by the Judicial review because i got my approval letter in November 2005 and entry visa on 10-03-06 , four yeears extention in May, 2007. Do i need to have specific amount of savings or funds before applying for my ILR together with my family. Secondly, my 15yr old daughter then is above 18, am i going to pay separate application fee for her.

Funds are always improtant but if you ar on a HSMP and working you should be fine. I believe you will have to pay fr your daughter – or she could use her own pocket money!!

I received my approval latter on 31-Jan 2006. My Visa stamping on 5th-April 2006. So i am apply for my ILR after 4 years or not?

I have been living in UK as Tier 1 Migrant for past five years and now i am applying for ILR (Indefinite Leave to Remain).
Now, problem is that i have been out of the country for about 215 days in total in all five years. Also once i stayed 98 days at a time in my country because my wife was not well. Now could someone tell me that whether i can qualify for ILR or i have to apply for another extension and what is the policy for TIER 1 immigrants with regards to absence from the country.
Also where i can find this information regarding absence on the Home Office website.

Dear Sir,
I write to seek your advice regarding my ILR as an HSMP holder who is due to apply this coming JUN 2010.
I am self employed person who run an IT company since 2006. I carry all neccessary TAX and account required by the Government.
I have alot of software installation developed/supported and maintained by my company in Afirca which require me to travel to africa to attend to my client at least within 3 month interval and for a period of 2 weeks at a go and sometimes more depending on my cleint problems.
If I calculated the no of times i have travelled out of UK all together within the last 4 yaers it will be 8-7 months. I
Can you please advice me if I am affected by the law of 6 months outside UK before ILR is issued.

Hi,
I first came to the UK on the 2 year working holiday visa, which expired April 2006. From within the UK I applied and had my HSMP approved in Dec 2005 but didn’t apply for the LtR until April 2006.
My question is: did my 4 years continuous residence start from Dec 2005 when my HSMP was approved or from April 2006 when my LtR was granted?

I am uncertain on this and every case is judged within different varying factors, you do look to have a strong case however, good luck.
