Another look at UK work visa law

The chairman of the Migration Advisory Committee has admitted on BBC radio that the rules on intra-company transfers (ICTs) may need to be reviewed once more.

Speaking on BBC Radio 5, one of the government’s primary immigration advisors stated that the rules on allowing foreign employees of companies to move to the UK, to work in a firm’s UK offices, may need “another look.”

Professor David Metcalfe added that if the changes to the rules that are scheduled to be introduced in 2010 are not effective, UK immigration would “have to” rethink the rules again.

He talked of how IT contractors in the UK are still claiming that their jobs are being taken by Indian IT experts who are coming to work in the UK with work visas obtained by their companies that have offices in both India and the UK.

This intra-company-transfer system is intended to be used by firms that wish to bring in experts from abroad to do certain jobs. The company can then use the ICTs to gain a work permit for the skilled worker to work in the UK in a specific role. However, there is growing concern than the system is being abused by firms who are simply using it to undercut the domestic British workforce.
