UK immigration to review visa rejections
July 27 2010 by Liam Clifford
Those who unsuccessfully applied for UK visas between 23 June and 22 July this year, on the grounds of inadequate financial means, are to have their rejected applications reviewed.
The announcement has come from the UK Border Agency, which
explained that the review would apply to applications from all tiers of the UK
points based system.
The review is taking place because the high court
has ruled that maintenance funds assessments must be in line with UK immigration
regulations. These state that the required funds must be in the applicants’ bank
accounts on the day the application was made.
The court ruled that
restrictions brought in by the UK Border Agency were not officially part of UK
immigration rules and were not binding. The Border Agency tried to introduce a
rule that required applicants to show the required cash funds were in their bank
for a full three months before applying for their UK visa.
Many people
found this difficult to show and were therefore rejected for a UK visa during
the month-long period above. These people will now have their applications
reviewed in an attempt to make the system more fair.
